Privacy notice for applicants

Compliance with data protection regulations is a high priority for us. In the following, we would like to inform you about the collection and processing of your personal data. You are being sent a copy of this privacy notice because you are applying for work with us or have been contacted by us for a suitable work opportunity (whether as an employee, worker or contractor). It makes you aware of how and why your personal data will be used, namely for the purposes of the recruitment exercise, and how long it will usually be retained for. It provides you with certain information that must be provided under the General Data Protection Regulation ((EU) 2016/679) (GDPR).

Purpose and legal basis

We process your personal data for the purpose of deciding on the establishment of the employment relationship. As part of the application process, we process your contact details, your name and address, as well as all data related to the application, such as CV, certificates, qualifications. If you submit an application for reimbursement of travel expenses, we also require your bank details. The legal basis for the processing of your data results from Art. 88 GDPR in conjunction with § 26 para. 1 sentence 1 BDSG (federal data protection law – Bundesdatenschutzgesetz) or Art. 6 para. 1 sentence 1 lit. b GDPR.

We also collect and process personal data that you provide to us voluntarily. This data is processed on the basis of your revocable consent in accordance with Art. 6 para. 1 sentence 1 lit. a, Art. 7 GDPR in conjunction with Section 26 para. 2 BDSG.

Talent pool

If you are not hired but your application is still of interest to us, we may ask you whether we may keep your application on file for future vacancies. This longer retention period is based on your revocable consent in accordance with Art. 6 para. 1 sentence 1 lit. a, Art. 7 GDPR in conjunction with Section 26 para. 2 BDSG. Inclusion in our talent pool is voluntary and failure to grant the corresponding consent has no effect on other ongoing application procedures.

Type of data and data source

We process the following data:

  • Master data
  • Contact details
  • Details of your professional CV, educational and professional experience and references

The data comes from your professional networking profile, the references you have named or from recruitment agencies with which we have concluded corresponding agreements.

Recipients of your data

We will of course treat your data confidentially. If you apply for a position with us for which only our IQPC Ltd. has the relevant specialist department, specialists from the IQPC Ltd. department may have access to your applicant data for the purpose of assessing your suitability for the position. If your application may be of interest to our parent or sister companies, we will ask you for your consent to forward the application to the company. This is done on the basis of your revocable consent in accordance with Art. 6 para. 1 sentence 1 lit. a, Art. 7 GDPR in conjunction with § 26 para. 2 BDSG.

We use strictly instruction-bound service providers (e.g. LinkedIn Corporation, Microsoft Corporation) who support us, for example, in the areas of IT or the archiving and destruction of documents and with whom separate contracts for order processing have been concluded. When transferring data to third countries, we ensure that there is an adequate level of data protection on the recipient side, either by having an adequacy decision (e.g. EU-U.S. Data Privacy Framework) or by concluding standard data protection clauses.

Data erasure

If there is no legal retention period, the data will be erased as soon as it is no longer necessary to store it or the legitimate interest in storing it has expired. If you are not hired, this is usually no later than three months after completion of the application process or after receiving a rejection of your application. We also erase your data if you withdraw your consent. In certain cases, data may be stored for a longer period of time (e.g., travel expense reports). The duration of retention depends on legal storage obligations, which may for example stem from the German Fiscal Code (6 years) or the German Commercial Code (10 years). Further storage of your data is also permitted if further processing is necessary to assert, exercise, or defend legal claims.

Automated individual decision-making

As the decision on your employment is not based exclusively on automated processing, no automated decision in individual cases within the meaning of Art. 22 GDPR takes place.

Your rights

As a data subject, you have the right of access to personal data concerning you (Art. 15 GDPR), as well as the right to rectification to have inaccurate data corrected (Art. 16 GDPR). You also have the right to erasure if one of the reasons mentioned in Art. 17 GDPR applies, e.g., if the data is no longer needed for the aims pursued. Furthermore, you have the right to restriction of processing if one of the conditions listed in Art. 18 GDPR applies and, in the cases of Art. 20 GDPR, the right to data portability. If the processing of data is based on your consent, you are entitled to withdraw it at any time in accordance with Art. 7 GDPR. Please note that the withdrawal is only effective for the future and that processing that took place before the withdrawal remains lawful. Please also note that we may have to retain certain data for a specific period of time in order to comply with legal requirements, despite your revocation (see "Data erasure" for more details).

Right to object

In cases where we process your personal data on the legal basis of Art. 6 (1) e or f GDPR, you have the right to object at any time for reasons arising from your particular situation. We will then no longer process your personal data unless we demonstrate compelling legitimate reasons for continuing the processing which override your interests, rights, and freedoms. This also applies where the processing serves the assertion, exercise, or defence of legal claims.

Furthermore, as a data subject, you have the right to lodge a complaint with a supervisory authority if you are of the opinion that the processing of your personal data violates data protection provisions. The right of complaint may, in particular, be brought before a supervisory authority in the Member State of the place of your habitual residence, your workplace, or of the place of the alleged infringement.
